1. About these terms
These Terms of Service ("Terms") form a binding agreement between you and Yebo Yum (Pty) Ltd ("Yebo Yum", "we", "us"). By creating an account or using the Yebo Yum apps, partner portal, or yeboyum.co.za website (collectively, the "Service"), you agree to these Terms and to our Privacy Policy.
If you do not agree, please do not use the Service.
2. What Yebo Yum is, and what it is not
Yebo Yum is a marketplace: we introduce customers to partner food businesses that have surplus food to sell at a discount in Rescue Bags. We facilitate the booking and payment, but we are not the producer, manufacturer, or seller of the food itself. The contract of sale for each Rescue Bag is between you and the relevant partner.
We do not guarantee the availability, contents, portion size, or quality of any Rescue Bag. The contents are, by design, a surprise made up of that partner's unsold stock on the day.
3. Eligibility and accounts
- You must be at least 18 years old, or have the permission of a parent or guardian, to create a customer account. Partner accounts may only be created by a person authorised to act on behalf of the business.
- You must provide accurate account information and keep it up to date.
- You are responsible for keeping your login credentials secure. Any activity from your account is your responsibility until you notify us of a compromise.
- You may close your account at any time from the app (Profile → Delete my account) or by emailing support@yeboyum.co.za.
4. Rescue Bags: booking and collection
4.1 Booking
When you reserve a Rescue Bag, your card is charged immediately for the advertised price. Once payment is confirmed we generate a unique QR code that identifies your order to the partner. The booking is only confirmed once payment clears.
4.2 Collection window
Each Rescue Bag has a collection window set by the partner. You must collect the bag during that window and present your QR code. If you do not collect within the window, the partner may release the bag and you will not be eligible for a refund, subject to section 6 below.
4.3 Contents and substitutions
The contents of a Rescue Bag reflect whatever surplus the partner has on the day. The partner may substitute items of equivalent or greater value. We do not guarantee any particular item appears in your bag.
4.4 Dietary information and allergens
Partners are required to indicate broad dietary categories (for example "contains nuts", "contains dairy", "vegetarian") on their Rescue Bag listings. Because contents vary, partners cannot guarantee that a bag is free of any specific allergen unless the listing explicitly says so. If you have a serious food allergy, do not rely solely on category labels; contact the partner directly before collection to confirm.
5. Your responsibilities as a customer
- Provide accurate information when creating and using your account.
- Collect bags within the stated collection window, or cancel in time (see section 6).
- Do not resell the contents of a Rescue Bag.
- Treat partner staff with respect. Abusive behaviour may result in suspension.
- Leave ratings and reviews in good faith, based on your own experience. Do not post offensive, defamatory, or commercially motivated content.
6. Cancellations and refunds
- Customer cancellation — you may cancel a Rescue Bag up until 30 minutes before the start of the collection window for a full refund. Cancellations made after that point are not automatically refundable.
- Partner cancellation — if a partner cancels, closes unexpectedly, or cannot fulfil your order, you will receive a full refund to your original payment method.
- Complaints about contents — if the bag is materially different from what was advertised, spoiled, unsafe, or contains an allergen despite the listing stating otherwise, contact us within 48 hours of collection at support@yeboyum.co.za. We will investigate and, where appropriate, issue a full or partial refund.
- Nothing in this section limits your statutory rights under the Consumer Protection Act 68 of 2008 (South Africa).
7. Partners: your additional obligations
If you use Yebo Yum as a partner business, you also agree that:
- You are legally permitted to sell food in your jurisdiction and hold any required municipal or health permits.
- All food sold through Yebo Yum will be fit for human consumption at the moment of collection, stored at appropriate temperatures, and comply with applicable food-safety regulations.
- You will honour every confirmed booking during its stated collection window, or cancel the order promptly if you cannot fulfil it.
- You will provide accurate listings, including price, collection window, and broad dietary / allergen categories.
- You grant Yebo Yum a non-exclusive licence to display your business name, logo, and listing details within the Service for the purpose of operating the marketplace.
- You are solely responsible for paying your own taxes (VAT, income tax, etc.) on the revenue you receive via Yebo Yum.
8. Payments and service fee
Payments are processed by Peach Payments (Peach Payments (Pty) Ltd), a licensed South African payment service provider. Card details are tokenised and are never stored on Yebo Yum's servers.
Yebo Yum charges partners a service fee on each Rescue Bag sold through the Service. The applicable fee is communicated to partners in the partner portal and may change on reasonable notice. Payouts to partners are made on the schedule shown in the partner portal and are net of the service fee and any refunds issued in the relevant period.
All prices shown to customers include applicable taxes unless stated otherwise.
9. Acceptable use
You must not:
- Use the Service for any unlawful purpose, or to facilitate illegal activity.
- Reverse-engineer, copy, or build a competing product from the Service.
- Attempt to gain unauthorised access to any part of the Service, other accounts, or our infrastructure.
- Scrape, bulk-download, or otherwise harvest data from the Service.
- Upload malware, or content that is unlawful, defamatory, or infringes the rights of others.
- Impersonate another person, business, or Yebo Yum staff member.
We may suspend or terminate accounts that breach these rules, and may remove content at our discretion.
10. Intellectual property
The Yebo Yum name, logo, app design, source code, and all related marks are owned by Yebo Yum (Pty) Ltd. You are granted a limited, revocable, non-exclusive licence to use the Service for its intended purpose. Nothing in these Terms transfers ownership of our intellectual property to you.
Content you submit (reviews, photos, partner listings) remains yours, but you grant Yebo Yum a worldwide, royalty-free licence to host, reproduce, and display that content as part of operating the Service.
11. Availability and changes
We aim to keep the Service available and working, but we do not guarantee uninterrupted operation. We may add, change, or remove features, and we may update these Terms from time to time. Material changes will be announced in the app or by email; the "Last updated" date at the top of the page reflects the most recent revision. Continued use of the Service after a change means you accept the updated Terms.
12. Limitation of liability
To the maximum extent permitted by law:
- Yebo Yum provides the Service "as is" and makes no warranties beyond those required by the Consumer Protection Act.
- Yebo Yum is not liable for indirect, consequential, or incidental losses (including lost profits, lost data, or reputational harm) arising from your use of the Service.
- Our aggregate liability to you for any claim connected with the Service is limited to the total amount you paid Yebo Yum in the 12 months before the event giving rise to the claim, or ZAR 500, whichever is greater.
- Nothing in these Terms excludes liability that cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, for fraud, or under the Consumer Protection Act.
Food safety and the fitness of Rescue Bag contents are primarily the responsibility of the partner who supplied the bag.
13. Indemnity
You agree to indemnify Yebo Yum against reasonable claims, damages, and costs arising from your breach of these Terms, your misuse of the Service, or — if you are a partner — your sale of unsafe or incorrectly described food.
14. Suspension and termination
We may suspend or terminate your account if you materially breach these Terms, if required by law, or if we reasonably believe your continued use poses a risk to other users or to the Service. Where practical we will give notice and an opportunity to remedy the breach. You can terminate your account at any time as described in section 3.
On termination, sections that by their nature should survive (including sections 10, 12, 13, 15, and 16) will continue to apply.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. If a dispute arises, we will first try to resolve it informally — please email support@yeboyum.co.za and give us a reasonable chance to respond.
If that does not resolve things, you may refer the matter to the National Consumer Commission or the relevant consumer tribunal, or bring proceedings in a South African court of competent jurisdiction. Nothing in these Terms limits your rights under the Consumer Protection Act or POPIA.
16. General
- Entire agreement — these Terms, together with the Privacy Policy and any partner-specific addendum, form the entire agreement between you and Yebo Yum regarding the Service.
- Severability — if any provision is held unenforceable, the remainder continues in full force.
- No waiver — a failure to enforce a right does not waive that right.
- Assignment — you may not assign your rights under these Terms; we may assign ours as part of a corporate reorganisation or sale of the business.
- Notices — we may send notices to the email address on your account. You can reach us at support@yeboyum.co.za.
